Nudging Financial Decisions: Protecting Weaker Parties while Promoting Autonomy

Abstract

The article examine whether, and to what extent, the American Consumer Financial Protection Bureau (CFPB) can serve as a model for other jurisdictions. Topics discussed include structure of the financial regulation in Israel and the U.S.; regulatory structure that maintain separation between prudential regulation and consumer protection; and prudential regulation and conduct of business regulation.
