In Dutch law it is possible to attach an obligation to property by means of the 'qualitative obligation' placed in Article 6:252 of the Civil Code. In this research the central questions are if the qualitative obligation is a fit instrument to bind an obligation to property and what position the obligation occupies within the Dutch legal system?
